Employers must understand the confidential nature of clinical information.It is not acceptable for management or personnel/ HR staff to have any access to medical records, or for medical records to be kept with personnel/ HR records.
Unrestricted access to the clinical data should be confined to the occupational physician and the occupational health nurse. Where medical support staff such as medical secretaries will handle some records. It is the duty of the physician to explain the strict confidential nature of such records. Each individual should sign an undertaking to treat any records in strict medical confidence.
Where occupational physicians act as line managers for their own staff, they have no special privilege to access to medical information on their reports.
